By booking, participating in, or using any services provided by Kawi Nature (Kawi Mangrove), you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
1. General
1.1 These Terms & Conditions apply to all activities, packages, and services offered under Kawi Nature, including but not limited to:
Kawi ATV Ride (including Kawi Nature experience)
Kawi Mangrove packages (Quick Explorer, Extended Discovery, Comprehensive Journey, Mangrove Sharing)
Kawi Jet Ski (Open Water & Mangrove)
Kawi Private Yacht (Chartered & Sharing)
Any upcoming products including Kawi Night Life (Coming Soon)
1.2 Kawi Nature reserves the right to amend, update, or change these Terms & Conditions at any time without prior notice.
2. Booking & Availability
2.1 All bookings are subject to real-time availability via our booking system.
2.2 Time slots shown on the website are indicative only and may change due to operational, weather, or safety reasons.
2.3 A booking is considered confirmed only after full payment has been successfully received.
2.4 Walk-in bookings are subject to availability and may not be guaranteed.
3. Pricing & Payment
3.1 All prices listed are in Ringgit Malaysia (MYR) unless stated otherwise.
3.2 Pricing structure:
ATV & Jet Ski: Charged per vehicle (not per person). Maximum 2 persons per vehicle unless stated otherwise.
Boat & Yacht (Private): Charged per boat or yacht for the stated duration.
Sharing Tours: Charged per person (pax).
3.3 Prices are subject to change without prior notice due to fuel cost, operational changes, or regulatory requirements.
3.4 Full payment is required prior to the commencement of any activity.
4. Cancellation, Reschedule & Refund Policy
4.1 Deposit & Payment
All bookings require a deposit or full payment as stated in the booking system at the time of reservation.
4.2 Non-Refundable Policy
All deposits and payments made are strictly non-refundable under any circumstances, including but not limited to:
Customer cancellation
No-shows
Late arrivals
Weather conditions
Personal emergencies
Changes in travel plans
4.3 Rescheduling requests are subject to availability and are solely at the discretion of Kawi Nature. Rescheduling is not guaranteed.
4.4 Kawi Nature reserves the right to cancel or modify activities due to safety, weather, or operational reasons. In such cases, guests may be offered rescheduling or credit at Kawi Nature’s discretion. No cash refunds will be provided.
5. Weather & Safety Conditions
5.1 All activities are subject to weather, sea, and environmental conditions.
5.2 Kawi Nature reserves the right to modify routes, checkpoints, or duration for safety reasons without prior notice.
5.3 Safety briefings must be followed at all times. Failure to comply may result in immediate termination of the activity without refund.
6. Health, Fitness & Responsibility
6.1 Guests must ensure they are in good physical and mental health before participating.
6.2 Activities are not recommended for:
Pregnant women
Guests with serious medical conditions
Guests under the influence of alcohol or drugs
6.3 Guests participate at their own risk and are responsible for their personal safety and belongings.
7. Liability & Indemnity
7.1 Kawi Nature, its owners, staff, partners, and operators shall not be held liable for:
Personal injury
Loss or damage to personal belongings
Delays or cancellations due to factors beyond our control
7.2 By participating, guests agree to indemnify and hold harmless Kawi Nature against any claims arising from their participation.
8. Insurance
8.1 No insurance is provided by Kawi Nature for any activities, tours, or packages offered.
8.2 Guests acknowledge and agree that participation is entirely at their own risk.
8.3 Guests are strongly advised to obtain personal travel, accident, and medical insurance prior to participating in any activity.
9. Conduct & Behaviour
9.1 Guests must behave responsibly and respect:
Tour guides and crew
Other participants
Wildlife and natural environment
9.2 Any unsafe, abusive, or disruptive behaviour may result in removal from the activity without refund.
10. Wildlife & Environmental Protection
10.1 Feeding wildlife is only permitted when supervised by authorized guides.
10.2 Guests must not:
Damage mangroves or natural surroundings
Litter or pollute waterways
Failure to comply may result in penalties or termination of the tour.
11. Photography & Media
11.1 Kawi Nature reserves the right to use photos and videos taken during activities for marketing and promotional purposes.
11.2 Guests who do not wish to appear in media content must inform staff prior to the activity.
12. Late Arrival Policy
12.1 Guests are required to arrive at least 15 minutes early before the scheduled departure time.
12.2 Late arrivals may result in:
Shortened activity duration, or
Cancellation without refund
13. Children Policy
13.1 Children must be supervised by a parent or legal guardian at all times.
13.2 Minimum age requirements may apply to certain activities such as ATV and Jet Ski rides.
14. Governing Law
14.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Malaysia.
